The Canadian Lung Association (the “Association”) is the sponsor of the #BeABreath Contest described herein.
To Enter: Qualifying participants (“Participants”) who either:
- donate a minimum of $5 through our landing page, and fill out and submit the required form via lung.ca; or
- print off the required form as well as a signed copy of the rules and regulations, complete it, and mail it to The Canadian Lung Association, “BeABreath Contest”, 885 Meadowlands Dr., Suite 502, Ottawa ON, K2C 3N2.
between November 5 and 30, 2018 (“Contest period”) will be entered to win one of seven (7) potential prizes.
One donation accounts for one entry, regardless of the donation amount, as long as it is $5 or greater.
To be eligible for an entry by mail, each form mailed to The Canadian Lung Association must be in a separate, individually mailed and post-marked envelope.
Every Participant is allowed to donate as many times as he/she likes during the contest period.
Every Participant is qualified to win prizes at any level (see “Prizes”) below. Entries become the property of The Canadian Lung Association and will not be returned.
No purchase or donation is required to enter.
Prizes: There are five prizes in total.
Prize 1: There will be three (3) $100 e-gift certificates to be redeemed through lifeexperiences.ca. The total value of all three prizes is $300.
Prize 2: The prize is a trip valued at approximately $1,000. It includes a certificate for a two-night (2) stay for two (2) persons at one of the following Fairmont properties, to be selected by the winning Participant (“Winner”):

Prize 3 (“Grand Prize”): The Grand Prize will be a vacation for two (2) people valued at $4,000 in the form of a gift certificate for Flight Centre.
Drawing: The draw for all levels of prizes will occur between December 3 and 7, 2018 in Ottawa, Ontario. Prizes must be accepted as awarded. The Association reserves the right to substitute any of the prizes with other prizes of equal or greater value if any prize cannot be awarded as described for any reason. Prizes are non-transferable and are not redeemable for cash or credit, in whole or in part. The Winners will be notified via email and will be required to answer a skill-testing question. Should the Winner not respond correctly or not respond within a set time limit, an alternative winner will be selected at random.
Eligibility: To be eligible to win any Prize, an entrant must: a) be a Canadian resident (other than Quebec residents); b) have reached the age of majority in the province or territory in which she/he resides as of 12:01 a.m., Monday, November 5, 2018; c) not be an employee, representative or agent of The Canadian Lung Association, any provincial Lung Association nor be a Board Member of the national or any provincial Board tied to a Lung Association, or be someone domiciled with any such person, and d) have read and agreed to the above rules and regulations.
Contest is not open to Quebec residents.
The Contest is subject to all applicable federal, provincial, and local laws and regulations, excluding Quebec where the Contest will not be active.
Odds: The odds of winning the Prizes depend on the total number of eligible entries received throughout the Contest Period.
Use of Information: By opting to be a Participant, the donor agrees to be entered into the Contest. If selected as a potential Winner for the Contest, it will be necessary for The Canadian Lung Association to verify that a potential Winner fulfills the eligibility criteria for the Contest. All Participants agree to be potentially contacted by The Canadian Lung Association with respect to this Contest. Personal information provided to enter this contest will be used only in relation to this contest. Questions about the collection of this information can be directed to mstastna@lung.ca.
Winner Notification/Prize Awards: All potential Winners will each be notified via e-mail or phone (using contact information provided) by a representative of The Canadian Lung Association within 24 hours of the draw. In order to win a prize, a selected entrant must correctly answer, unaided, a time-limited, arithmetical, skill-testing question and sign and return to The Canadian Lung Association a declaration and release form (i) by email within three (3) business days, and (ii) the original by mail within 7 business days, from the time the prize notification is marked as having been sent by The Canadian Lung Association by e-mail. The skill-testing question and the Release will be included electronically in the prize notification e-mail. The Prize will be forfeited and available to be awarded to the alternate winner following the procedures set forth above if: (a) the prize notification is returned as non-deliverable; (b) if the signed Release, including skill testing question, is not returned by email within three (3) business days from the time the prize notification e-mail is marked as having been sent; or (c) if the skill-testing question is incorrectly answered. In the event the prize notification e-mail is returned as non-deliverable from the alternate winner, the alternate winner does not return the required documentation by email within three (3) business days, and/or the skill-testing question has been incorrectly answered by the alternate winner, the Prize will be forfeited and not awarded to any further alternates.
Additional Terms: By participating, all Participants agree to: (a) these Rules and the decisions of The Canadian Lung Association, which shall be final and binding without right of appeal in all respects; and (b) release, discharge, indemnify and hold harmless The Canadian Lung Association, its Board of Directors, employees, officers, their advertising or promotional agencies, and any of the foregoing entities’ respective officers, directors, affiliates, related entities, partners, partnerships, principals, representatives, agents, licensees, employees, vendors, successors and assigns (collectively the “Contest Parties”) from any liability, claims, or damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest, an entrant’s participation in the Contest, and/or the acceptance or use, misuse, or possession of a Prize. By accepting a Prize, each winner agrees to The Canadian Lung Association’s and its designee’s use of his/her name, city, province or territory of residence and/or photograph or other likeness for advertising and publicity purposes without notice or compensation. All national, provincial and local laws and regulations apply.
Limitation of Liability: The Contest Parties shall not be responsible for print or typographical errors in the offer or administration of the Contest or any other Contest-related materials; for lost, late, misdirected, damaged, or incomplete entries; or for or for transactions that are posted late or incorrectly or are lost; or for miscommunication, computer or electronic malfunction. The Canadian Lung Association reserves the right to cancel, suspend, or modify the Contest at any time in their sole discretion, without prior notice.
Privacy Policy: By entering this Contest, you consent to The Canadian Lung Association and its promotional agencies storing and using the personal information submitted through automatic entry for the purpose of administering the Contest in accordance with these Rules.
